HIGH COURT OF TELANGANA
P.SREE SUDHA, J
P.Umarani – Appellant
Versus
State Bank Of Hyderabad – Respondent
WP/22343/2004
The court ruled that the rejection of the petitioner's regularization due to age was unjust, emphasizing the need for fair employment practices in public sector entities.
Headnote:(A) Employment Law - Regularization of Services - The petitioner sought regularization of her service as a casual labourer after 240 days of engagement, claiming unfair treatment compared to juniors who were regularized. The court found that the rejection on the basis of age was improper, especially as juniors were absorbed. (Paras 2, 8)
(B) Judicial Precedent - The court referred to the principle established in Secretary, State of Karnataka and others Vs. Uma Devi, [2006 (4) SCC 1], regarding regularization rights of employees and emphasized fair employment practices in public sectors. (Paras 5, 6)
Facts of the case:
The petitioner had been working since 1994 but was denied regularization due to age, despite being recommended for positions. (Paras 2, 8)
Findings of Court:
The court directed regularization of the petitioner from 07.05.2004 and payment of retirement benefits. (Paras 8, 9)
Issues: The main issues were the justification for denying regularization based on age and the treatment of the petitioner compared to other employees.
Ratio Decidendi: The court ruled that the rejection of the petitioner’s application was unjust, given her long service and the regularization of less senior employees.
Result: Writ petition allowed, directing regularization and payment of benefits.
ORDER:
This writ petition is filed by the petitioner seeking direction to the respondents to regularize her services immediately after the day of completion of 240 days of her engagement.
