ORDER:

This Contempt Case is filed to punish the respondent/contemnor for deliberate and willful disobedience of the Order dated 20.08.2024 passed by this Court in C.C.No.2243 of 2023.

2. The learned Counsel for the petitioner herein contended that petitioner herein had filed O.S.No.1025 of 2012 for recovery of suit amount of Rs.39,60,000/- and on 20.08.2024, this Court directed the respondent to deposit the decreetal amount along with interest, but the respondent came up with a request to modify the order and the same was not considered. The said direction was not complied with.

3. In spite of specific direction of the Court, the respondent did not comply the order of this and it amounts to willful disobedience of the Orders of the Court. Therefore, this Court finds that the respondent is liable for punishment of Simple Imprisonment for a period of three (03) months along with a fine of Rs.2,000/-.

4. In the result, the Contempt Case is allowed. As per Section 12 of the Contempt of Courts Act, respondent is liable for Simple Imprisonment for a period of three (03) months and also to pay a fine of Rs.2,000/-. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
