JUDGMENT:

This Second Appeal is filed challenging the judgment and decree dated 18.02.2025 passed in A.S.No.22 of 2024 by the V Additional District Judge at Bodhan, Nizamabad District, whereby and where appeal was dismissed and the judgment and decree dated 12.09.2024 in O.S.No.340 of 2023 on the file of the Senior Civil Judge at Bodhan was confirmed.

2. When the matter is taken up for hearing, the learned counsel for the appellant submits that pursuant to the orders passed by this Court on 03.03.2025 in I.A.No.1 of 2025 in S.A.No.84 of 2025, the appellant filed an undertaking by way of an affidavit before the trial Court as well as this Court on 10.03.2025 that appellant will pay rents regularly to the respondents and also undertake to vacate the suit schedule premises on or before 31.07.2025.

3. In view of the undertaking-cum-affidavit filed by the appellant before this Court as well as trial Court dated 10.03.2025, the second appeal is dismissed. However, the appellant shall comply with undertaking filed before the trial Court as well as this Court without any defult.

4. Accordingly, the Second Appeal is dismissed. There shall be no order as to costs.
