HIGH COURT OF TELANGANA
C.V. BHASKAR REDDY, J
Narsampally Veeraiah – Appellant
Versus
The State of Telangana – Respondent
WP/2398/2025

Advocates:
For the Appellants/Petitioners:
For the Respondents: Sri L.Ravinder

Delay in seeking correction of revenue records restricts entitlement under applicable land laws.

Headnote:The judgment discusses the rights concerning agricultural land under the Telangana Rights in Land and Pattadar Passbooks Act, 1971 and Act 9 of 2020. The petitioner purchased land in 2007 and applied for mutation in revenue records, but the authorities did not act. The court reinforces that correction of records cannot be made after an unreasonable delay. The court allows the petitioner to approach a civil court for declaration of ownership. The writ petition is disposed of accordingly.

Table of Content
1. ownership and possession established through purchase. (Para 1)
2. submission from respondent regarding petitioner’s inaction on revenue record update. (Para 2 , 3)
3. clarity on delayed applications under relevant land laws. (Para 4)
4. court's decision to allow a civil action for title declaration. (Para 5 , 6)

ORDER

It is stated that the petitioner has purchased the agricultural land admeasuring Ac.1.23 guntas in Sy.No.89/VU of Baswapur Village, Mulugu Mandal, Siddipet District, through registered sale deed bearing document No.5616 of 2007, dated 22.05.2007 and since the date of purchase, he has been in possession of the said land. It is further stated that the petitioner’s vendors and their predecessors are absolute owners of the subject property and they were also issued pattadar passbooks and title deeds under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971 (for short “the ROR Act, 1971”) and the Rules made thereunder. It is further stated that the petitioner has made online application No.2400122545, dated 19.11.2024 seeking for mutation of his name in the revenue records and consequential issuance of e- pattadar passbook under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2020 (for short “the Act 9 of 2020”). The grievance of the petitioner is that even after receiving the said application, the respondent authorities are not considering the same.

2. Considered the submissions of the learned counsel for the respective parties and with their consent, this writ petition is being disposed of at the admission stage.

3. Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents has vehemently contended that though the petitioner has purchased the property in the year, 2007, till now he has not taken any steps for updation/mutation of his name in the revenue record. Learned Assistant Government Pleader further submitted that if the petitioner has acquired rights under registered sale deed, he ought to have taken steps for amending the record of rights by making appropriate application under Section 4 of the ROR Act, 1971.

4. It is settled principle of law that the parties are not entitled to seek correction of revenue entries after a long lapse of time and as per the provisions of the ROR Act, 1971 or Act 9 of 2020, the respondent authorities are not conferred with any power of entertaining the applications belatedly.

5. In view of the above, this Court, deems it appropriate to dispose of the writ petition granting liberty to the petitioner to approach the competent civil Court by instituting appropriate suit, if he is having valid title over the subject property, seeking to declare him as owner/pattadar of the subject property. In the event of granting any decree in favour of the petitioner, the respondent authorities are directed to issue pattadar passbook in his favour, in accordance with law.

6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
