ORDER

This writ petition is filed, under Article 226 of the Constitution of India , seeking the following relief:

“…to issue a writ or order/s more particularly one in the nature of writ of Mandamus declaring the action of the respondent nos.3 in not reconvening the title deed i.e., sale deed dated 19.10.1992 bearing document no.4562/92 to the petitioner inspite of clearing the loan by the petitioner as illegal, arbitrary and unjust and consequently direct the respondents to reconvey the title deed i.e., sale deed dated 19.10.1992 bearing document No 4562/92 to the petitioner and be pleased to pass…”

2. Learned Government Pleader for Agriculture submitted that the respondents are ready to give the paper publication to the effect that the documents are missing from their custody, if ordered by this Court.

3. Learned counsel for the petitioner submitted that the indemnity letter also should be given to the effect that the original documents are missing from the custody of the respondents and they are ready to furnish the same to the petitioner, if they are traced out subsequently.

4. The Superintendent of District Agriculture Officer, submitted that such indemnity letter will be given to the petitioner.

5. In view of the above submissions, this Court directs the respondents to issue the Indemnity letter to the petitioner to the effect that the original documents of the subject property which were in their custody are missing and that the same will be furnished as and when they are traced out. Further, they shall give a paper publication in the local newspapers both in Telugu and English, which have the largest circulation in the area in which the subject property is located to the above effect. The said paper publication shall be given within a period of three (03) weeks from the date of receipt of a copy of this order. Indemnity letter shall be given by the, District Agriculture Officer, Nalgonda, within the above mentioned period.

6. With the above observations, this writ petition is disposed of. There shall be no order as to costs.
