HON’BLE SRI JUSTICE C.V. BHASKAR REDDY WRIT PETITION No.35048 of 2023
ORDER
This writ petition is filed seeking the following relief:-
“…to pass an order or direction more particularly one in the nature of writ of mandamus or any other appropriate writ or direction holding that the action of Respondent Nos.6 and 7 in causing the interference in the marital life of Petitioners by involving themselves in the personal liberties of the petitioners and threatening the Petitioners with dire consequences and further the action of Respondent Nos.4 and 5 in refusing to grant protection to the Petitioners on their representation, dated 24.12.2023 is arbitrary, illegal, without jurisdiction, malicious and against the principles of natural justice…”
2. The case of the petitioners is that petitioner No.1 is permanent resident of Rajkot, Gujarat and petitioner No.2 is permanent resident of Muzaffarpur, Bihar. According to the petitioners both are majors and their marriage was performed at Arya Samaj, Laxmi Nagar, Hyderabad following hindu traditions and the Arya Samaj also issued a marriage certificate, dated 09.11.2023 under the Arya Marriage Validation Act No.19 of 1937. It is the further case of the petitioners that their parents especially father of petitioner No.1 and their relatives, who have not consented for their marriage, have threatened them with dire consequences and they are receiving threatening calls from respondent No.7 and other relatives. It is the further case of the petitioners that respondent No.7 and other relatives are trying to kill them in the name of ‘honour killing’ and in view of threat to their life they have made a representation/ complaint to respondent No.4, dated 24.12.2023. The grievance of the petitioners is that even after receiving the said representation, respondent No.4 is not providing necessary protection to their lives.
Learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 6, on instructions, would submit that the police have received the representation/complaint, dated 24.12.2023 and they are making enquiry on the said complaint and appropriate action would be initiated if the same discloses cognizable offence.
In view of the above submissions, this Court, deems it appropriate to dispose of the writ petition directing respondent No.4 to examine the complaint/representation, dated 24.12.2023 submitted by the petitioners and take appropriate action for protecting their lives from the threatening calls of respondent No.7 and other relatives, in accordance with law.
With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
