ORDER

This Writ Petition is filed seeking the following relief:

“…to issue any writ order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent No 3 who is Unnecessarily harrassing the petitioner though there is no name in crime No 142/2024 U/S 403 420 R/W 120B IPC Dated 15 05 2024 On The File of CCS DD Hyderabad Telangana making repeated phone calls and making the petitioner to come to police station who is not even connected with the present crime Respondent no 3 is also forcing the petitioner to produce Al and A3 in the above crime no 142 of 2024 though the petitioner is not known about them and threatening to implicate the petitioner in the present crime whatsoever also harassing the petitioner mentally which is illegal and arbitrary Consequently direct the Respondent No 3 not to harass the petitioner unnecessarily in crime No 142/2024 U/S 403 420 R/W 120B IPC Dated 15 05 2024 On The File of CCS DD Hyderabad Telangana Calling her to police station repeatedly without any reason and without following due process of law pending disposal of the main writ petition in the interest natural justice and to passto issue any writ order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondent No 3 who is Unnecessarily harrassing the petitioner though there is no name in crime No 142/2024 U/S 403 420 R/W 120B IPC Dated 15 05 2024 On The File of CCS DD Hyderabad Telangana making repeated phone calls and making the petitioner to come to police station who is not even connected with the present crime Respondent no 3 is also forcing the petitioner to produce Al and A3 in the above crime no 142 of 2024 though the petitioner is not known about them and threatening to implicate the petitioner in the present crime whatsoever also harassing the petitioner mentally which is illegal and arbitrary Consequently direct the Respondent No 3 not to harass the petitioner unnecessarily in crime No 142/2024 U/S 403 420 R/W 120B IPC Dated 15 05 2024 On The File of CCS DD Hyderabad Telangana Calling her to police station repeatedly without any reason and without following due process of law pending disposal of the main writ petition in the interest natural justice.

2. Heard Ms. Dr. M. Madhavi Latha, learned counsel appearing for the petitioner and learned Government Pleader for Home appearing for the respondents.

It is submitted by learned counsel appearing on behalf of petitioner that though petitioner is not involved in F.I.R.No.142 of 2024, dated 15.05.2024, registered for the offences under Sections 403, 420 read with Section 120B of Indian Penal Code, 1860, she is being summoned by respondent No.2 and being harassed consistently.

4. It is submitted by learned counsel appearing on behalf of respondent Nos.2 and 3 that petitioner is being summoned only to seek clarification as some of the amounts have been transferred into her account, which is said to be in connection with the said F.I.R.

5. It is the specific allegation on behalf of the petitioner that the respondents, in the name of investigation and clarification, are harassing the petitioner in spite of her name not being arrayed in the F.I.R., which is not in accordance with law.

6. Heard learned counsels, perused the record. Having regard to the rival submissions made by both the parties, it is not in dispute that the F.I.R. has been registered against certain individuals on 15.05.2024 under Sections 403 and 420 read with Section 120B I.P.C. and the matter is under investigation. The crux of the F.I.R. is that certain individuals have misappropriated an amount of Rs.4,00,00,000/- in the guise of training and job placements from students and have disbursed the said amounts to various persons i.e., total 85 in number as on date.

7. During the course of investigation, the Police have been seeking clarification by summoning the
