IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
B. Vijaysen Reddy, J
Toddy Tappers Cooperative Society TTCS – Appellant
Versus
The State of Telangana – Respondent
WRIT PETITION No.13186 OF 2024
The court held that where a statutory remedy of appeal is available under the Excise Act, the petitioner must exhaust such remedy before seeking writ relief, particularly in serious cases involving psychotropic substance adulteration.
Headnote:The petitioner challenged the suspension of their liquor licence under the Telangana State Excise Act, 1968, and the Telangana State Excise (Grant of Licence to sell toddy, Conditions of licence and tapping of Excise Trees) Rules, 2007, alleging violation of natural justice and lack of jurisdiction of the police in conducting raids. The case involved allegations of adulterating toddy with Alprazolam, a psychotropic substance under the Narcotic Drugs and Psychotropic Substances Act, 1985. The primary issue was whether the writ petition was maintainable in light of the statutory remedy of appeal under Section 63(1) of the Excise Act, 1968. The court observed that since a statutory remedy exists, the petitioners should approach the competent authority to resolve legal issues, including the competence of police raids. In view of the above, the writ petition is disposed of directing the petitioners to file appeal/revision under Section 63 (1) of the Excise Act, 1968.
