ORDER:

This Criminal Petition is filed under Section 523 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS Act’) to quash the order dated 04.07.2024 passed in Crl.M.P.No.2 of 2024 in Crime No.117 of 2024 by the learned Judicial Magistrate of Second Class, Alampur.

2. The brief facts of the case are that the petitioner filed the petition under Section 451 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) to return the Goods Carriage HMV bearing No. TS 12 UB 3758, which was seized by the Undavelly Police in Crime No.117 of 2024, registered for the offences punishable under Sections 6 and 10 of the Telangana Prohibition of Cow Slaughter and Animal Preservation Act, 1977, Section 11 of the Prevention of Cruelty of the Animals Act, 1960. After hearing both sides, the trial Court dismissed the said petition. Aggrieved by the said order, the present Criminal Petition is filed.

3. Heard Sri R. Gopi Mohan, learned counsel appearing on behalf of the petitioner as well as Sri S. Ganesh, learned Assistant Public Prosecutor appearing on behalf of the respondents.
