This writ petition is filed by the petitioners seeking to declare the action of respondents No.2 and 3 in not releasing the vehicle of the petitioner seized in connection with F.I.R. No.190 of 2024 registered with Miryalaguda I Town Police Station for the offences punishable under Section 8c read with Section 20(b)(ii)(C) and Section 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘NDPS Act), as being illegal, arbitrary and unconstitutional.

2. Heard Mr. B. Kanaka Ratna, learned counsel for the petitioner, and Mr. S. Laxmi Narayana, learned Assistant Government Pleader for Prohibition and Excise, and perused the material on record.

3. Learned counsel for the petitioner submitted that the petitioner is the registered owner of the vehicle having purchased the same by availing bank loan. The petitioner is eking out his livelihood from the income derived by giving the vehicle on hire. As per the contents of the report of respondent No.3 dated 12.07.2024, respondent No.3 along with his staff were conducting checking at Miryalaguda to Narketpally Road at Addanki-Narketpally Highw
