THE HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.29118 OF 2024 ORDER : (ORAL)

This writ petition is filed by the petitioner seeking to declare the action of respondent Nos.2 to 4 in freezing his bank accounts bearing Nos.881008235392 (DBS Bank) and 10167842115 (IDFC Bank) as being illegal and arbitrary.

2. Heard Mr. Aashir M Khan, learned counsel for the petitioner and Mr. G. Aniketh Reddy, learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, having received written instructions dated 21.10.2024 from the Assistant Commissioner of Police, EOW Team V, Central Crime Station, Detective Department, Hyderabad, submitted that investigation is being conducted in Crime No.200 of 2024 registered under Sections 403, 406 and 420 read with Section 120(b) of Indian Penal Code 1860 (IPC) and Section 5 of the Telangana Protection of Depositors of Financial Establishments Act, 1999 (TSPDFE). The investigation discloses that petitioner is a victim and Investigating Officer neither freezed the petitioner’s bank accounts nor addressed letters to bank authorities to debit freeze the bank accounts of the petitioner.

It is submitted that upon filing of this writ petition, enquiry was made by the Cyber Crime Team where it was revealed that one victim Mr. Madhu lodged a complaint in Cyber Crime website portal vide acknowledgment 23709240044437 against DKZ Technologies company. Based on the said complaint, the system has automatically freezed all the accounts related to dkztechnologies.com including the petitioner.

5. Learned counsel for the petitioner submitted that petitioner submitted a representation dated 03.10.2024 to respondent No.4 for de-freezing his bank accounts.

As it is stated by learned Assistant Government Pleader for Home that petitioner is a victim and bank accounts of the petitioner were freezed during the course of investigation, the writ petition is disposed of, directing respondent No.4 - the Deputy Commissioner of Police, Cyber Crime Police Station, Hyderabad, to consider the representation of the petitioner dated 03.10.2024 for de-freezing his bank accounts, in accordance with law, within a period of ten (10) days from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
