HON’BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION Nos.34119 and 34121 of 2024

COMMON ORDER:

The issues involved in these writ petitions are intrinsically interconnected and therefore, they are taken up and heard together and are being disposed of by this common order.

2. Writ Petition No.34119 of 2024 is filed by the petitioner seeking the following relief:

“….to pass an order or direction more particularly one in the nature of Writ of mandamus declaring the inaction of the Respondents to:

A) Evict the illegal encroachers from Khairati Inam lands meant for Khazayath Service of Khila Ghanpura and other Paraganas in Survey Numbers a) Survey No.72 an extent of Ac.02.31 gts of the land situated at Rudraram village, Nawabpet Mandal, Mahbubnagar. b) Sy.No. 798 an extent of Ac.02.27 gts. of the land situated at Yenmangandla village, Nawabpet Mandal, Mahbubnagar c) Sy.No. 19 an extent of Ac. 18.35 gts., and Sy.No. 20 an extent of Ac.03.11 gts. of the land situated at Thimmajipet village & Mandal, Nagarkurnool Dist. d) Sy.No. 361 an extent of Ac. 02.21 gts. of the land situated at Sankalmaddi village, Moosapet Mandal (the then Addakal Mandal), Mahbubnagar. e)Sy. No. 336 an extent of Ac. 06.03 gts. of the land situated at Ghanpur village & Mandal, Wanaparthy Dist. f) Sy. No. 17/1A an extent of Ac. 04.05 gts., Sy. No. 17/2B an extent of Ac. 04.19 gts. of the land situated at Ippalapalli village, and Sy. No. 336, Ac. 02.33 gts. of Marepally village and Sy. No. 37, Ac. 02.01 gts., Sy. No. 38, Ac. 01.29 gts., Sy. No.42, Ac. 04.34 gts., Sy. No. 43, Ac. 07.15 gts., Sy. No. 233, Ac. 03.24 gts., Sy. No. 234, Ac. 00.12 gts. of the land situated at Yedirepally village and Sy. No.10, Ac. 00.09 gts, Sy. No. 11, Ac.05.00 gts., Sy. No. 12, Ac.01.13 gts., Sy. No. 263 Ac. 00.32 gts., of Narellapally Village, and Sy. No.21, Ac.02.15 gts., Sy.No.109, Ac. 01.03 gts., Sy. No. 125 Ac. 01.38 gts., of the land situated at Thimmajipet village of Thimmajipeta Mandal, Nagarkurnool Dist. g) Sy. No. 471 Ac.4.09 gts. of the land situated at Yenmangandla Village, Nawabpet Mandal, Mahabubnagar Dist. h) Sy. No. 30/1, 30/2, 138/1, 138/2, 313/1, 313/2 and 24 measuring an extent of Ac.05.36 gts., Ac. 01.22 gts., Ac. 05.16 gts., Ac. 04.13 gts., Ac. 05.15 gts., Ac. 05.18 gts., and Ac. 01.26 gts. respectively situated at Devarakadra and Chowdarpalli villages of Devarakadra Mandal, Mahbubnagar District, by giving appropriate directions to the Respondent Nos. 2 to 11.

B) Consequently, direct the updation of the names of the Petitioners in Revenue Records including Dharani Portal as the land is Kahzayath Service land, by cancelling all illegal entries, Pattadar Passbooks and Title Deeds issued in favour of illegal encroachers, for the above Survey numbers and pass such other order(s), as are fit and just in accordance with Inams Abolition Act, 1955 and its Rules, 1975, under the circumstances in the interest of justice.…”

3. Writ Petition No.34121 of 2024 is filed by the petitioner seeking the following relief:

“….to pass an order or direction more particularly one in the nature of Writ of mandamus:

A) Declaring the inaction of the Respondents in not disposing Occupancy Rights Certificate (ORC) Applications, for Khairati Inam lands which are meant for Khazayath Service of Khila Ghanpura and other Paraganas in Survey Numbers a) Survey No. 72 an extent of Ac.02.31 gts of the land situated at Rudraram village, Nawabpet Mandal, Mahbubnagar. b) Sy.No. 798 an extent of Ac.02.27 gts. of the land situated at Yenmangandla village, Nawabpet Mandal, Mahbubnagar c) Sy.No. 19 an extent of Ac. 18.35 gts., and Sy.No. 20 an extent of Ac.03.11 gts. of the land situated at Thimmajipet village & Mandal, Nagarkurnool Dist. d) Sy.
