ORDER

Heard Sri D. Bhaskar Reddy, learned counsel for the petitioner and Mr.Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent No.1.

2. This Criminal Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (for short ‘BNSS’) to quash the proceedings against the petitioner herein in C.C.No.1216 of 2022 pending on the file of IV Additional Judicial Magistrate of First Class, Warangal.

3. Petitioner herein is accused No.2 and the offence alleged against him is under Section 180 of the Motor Vehicles Act, 1988 (for short ‘the Act, 1988’). The allegations levelled against the petitioner herein are that he is the owner of the quarry and Crime vehicle. He has appointed accused No.1/deceased No.3 as a driver to the tipper though he is an unlicensed person to drive heavy vehicles in quarry and committed an offence liable for punishment under section 180 of the Act, 1988.
