HON’BLE SRI JUSTICE K.SURENDER CRIMINAL APPEAL No. 2605 OF 2018

JUDGMENT:

The appeal is filed by the appellant/Accused aggrieved by the conviction recorded by the V Additional Metropolitan Sessions Judge-cum-XIX Additional Chief Judge at Hyderabad, in SC.No.29 of 2013, dated 29.08.2019, for the offence under Section 353 of the Indian Penal Code and Sections 181, 184(b) and 196 of Motor Vehicles Act and sentenced to undergo Rigorous Imprisonment for a period of six months and to pay fine of Rs.500/- for the offence under Section 353 of IPC; to pay fine of Rs.100/- for each of the offences under Sections 181, 184 and 196 of M.V.Act.

2. Heard Sri K.Siddharth Reddy, learned counsel for the appellant and learned Assistant Public Prosecutor for the Respondent State.

3. Briefly the case of the prosecution is that on 04.08.2011 at about 14.00 hours, PWs.1 to PW.4 who are Police personnel, were on PDA duty at old Chandrayangutta. PW.1 stopped the vehicle of the accused i.e. Esteem Car bearing No.AP 09C 3536 which was coming from MBNR X roads to Hafeez Baba Nagar, for checking.
