ORDER

This writ petition is filed seeking the following prayer:-

“to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents more particularly the respondent Nos.1 to 6 in not considering the petitioner representation, dated 16.04.2025 in trying to dismantle the Statue of Honored Jatipitha Mahatma Gandhi installed 3 years back at Ward No.15, near Bodrai area of Choutabetla Village, Kollapur Mandal, Nagarkurnool District, Telagnana State is illegal, arbitrary and consequently direct the respondent Nos.2 to 6 not to dismantle the Statue of Honored Jatipitha Mahatma Gandhi installed 3 years back at Ward No.15 near Bodrai area of Choutabetla Village, Kollapur Mandal, Nagarkurnool District, Telagnana State and to pass…”

Heard Sri P.N.Arun Kumar, learned counsel for the petitioner; learned Assistant Government Pleader for Home appearing on behalf of respondent Nos.1 and 6; learned Assistant Government Pleader for Revenue appearing for respondent Nos.2, 4 and 5 and Sri Putta Krishna Reddy, learned Standing Counsel appearing on behalf of respondent No.3. With the consent of the respective parties, this writ petition is being disposed of at the stage of admission.

3. Learned counsel for the petitioner restricts his relief to direct the respondent authorities to consider the representation, dated

16.04.2025 only, submitted by the petitioner. In view of the same, issuance of notice in respect of the unofficial respondent Nos.7 to

12 is dispensed with.

4. Learned counsel for the petitioner is an Ex-Ward Member of Ward No.15, Choutabetla Village, Kollapur Mandal, Nagarkurnool District and during his tenure, himself and other villagers, after collecting the funds, have constructed the statue of Mahatma Gandhi in the village. At the instance of the unofficial respondents, when respondent No.3 was trying to remove the said statue, the petitioner and other villagers have submitted a detailed representation before respondent Nos.2 to 6 requesting them not to remove the said statue. Learned counsel for the petitioner further submits that the respondent authorities, without passing any order on the said representation, are trying to remove the said statue.

Sri Putta Krishna Reddy, learned Standing Counsel appearing for respondent No.3, has submitted that respondent No.3-Municipality is not removing the statue and they are going to shift the statue to avoid the traffic. Learned Standing Counsel further submits that respondent No.3 would consider the representation submitted by the petitioner in accordance with law and requested this Court to grant reasonable time.

In view of the above submissions made by the learned counsel for the respective parties, this Court, without expressing any view on the merits of the matter, deems it appropriate to dispose of this Writ petition directing respondent No.3 to consider the representation, dated 16.04.2025, submitted by the petitioner and pass appropriate orders in accordance with law, within a period of four (04) weeks from the date of receipt of a copy of this order.

7. With the above directions, the Writ Petition is disposed of.

There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition shall stand closed.
