THE HON’BLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.6328 of 2025

ORDER:

This criminal petition is filed by the petitioner/accused under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail in Crime No.412 of 2025 on the file of Petbasheerabad Police Station, Cyberabad, registered for the offence punishable under Sections 69 and 108 of the Bharatiya Nyaya Sanhita, 2023 (BNS).

2. The case of the prosecution is that on 10.03.2025, the de facto complainant filed a complaint stating that his sister Miss. K. Priyanka, who is working in the purchase department of Dicel Pharma, Shamirpet, fell in love with one B. Ravi Kumar, the petitioner herein, who is working in the same company. The petitioner made promise that he will marry her and had physical relationship with her number of times. When the petitioner informed the sister of the de facto complainant that his parents are not accepting her, a quarrel took place between them on

09.03.2025 and 10.03.2025 and thereafter due to the severe mental agony, the deceased committed suicide by hanging herself to ceiling fan in her hostel. Basing on the same, the present crime has been registered.

3. Heard Smt. T.V. Laxmikantham, learned counsel for the petitioner, and Sri D.Arun Kumar, learned Additional Public Prosecutor for the respondent.

4. Learned counsel for the petitioner submits that the petitioner has not committed the offence and he was falsely implicated in the present crime. Even according to the allegations made in the complaint, the petitioner and the deceased are known to each other since long time and they fell in love. Hence, the ingredients of Section 69 of BNS do not attract against the petitioner. He further submits that at no point of time, the petitioner provoked or instigated the deceased to commit suicide. Hence, the ingredients of Section 108 of BNS do not attract against the petitioner. The only allegation levelled against the petitioner is that he refused to marry the deceased and the same will not come within the ambit of Section 108 of BNS. The petitioner was arrested on 11.03.2025 and since then he is in judicial custody. The entire investigation is completed except filing of the charge sheet. The petitioner is eking out his livelihood by doing private employment and he is not having any criminal antecedents and that he is ready and willing to cooperate with the investigation and also abide by the conditions that are going to be imposed by this Court.

5. Per contra, learned Additional Public Prosecutor submits that the petitioner has committed grave offence and there are specific allegations against him to attract the ingredients of Sections 69 and 108 of BNS. He further submits that the deceased in her suicide note had specifically mentioned the name of the petitioner and that due to him only she committed suicide. The investigation is under progress. At this stage, the petitioner is not entitled for grant of bail.

6. Having considered the rival submissions made by both the parties and after perusal of the material available on record, it reveals that specific allegations are leveled against the petitioner to attract the ingredients of Sections 69 and 108 of BNS. Even according to the learned Additional Public Prosecutor, the police seized the suicide note, wherein it is mentioned that at the instance of the petitioner only the deceased committed suicide. The investigation is under progress.

7. Taking into consideration the facts and circumstances of the case and also the gravity of offence, this court is not inclined to grant bail to the petitioner at this stage, especially when the investigation is under progress.

8. Accordingly, the criminal petition is dismissed.

Pending miscellaneous applications, if any, shall stand closed.
