IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
C.V. BHASKAR REDDY, J
Narkuda Yadaiah and 14 others – Appellant
Versus
The State of Telangana and 4 others – Respondent
WP/17935/2022

HON’BLE SRI JUSTICE C.V. BHASKAR REDDY WRIT PETITION No.17935 of 2022

ORDER:

The present writ petition is filed seeking to declare the action of the respondents Nos.2 to 4 in not mutating the names of the petitioners in the revenue records thereby not issuing digitalized e- pattadar passbooks and title deeds of Dharani Integrated Land Records Management System Government of Telangana to the petitioners in respect of land admeasuring Ac.3.00 gts., in sy.Nos.1146/27 and 1146/1, situated at Ibrahimpatnam Khalsa, Ranga Reddy District, as illegal, arbitrary and for other appropriate reliefs.

2. Considered the submissions of the learned counsel for the respective parties and perused the record.

3. It is stated that the petitioners belong to Scheduled Caste community and they are land less poor persons. It is further stated that they are eligible for assignment of various extents of lands for agriculture as per the policy laid down under the provisions of the Telangana Land Revenue Act, 1317 fasli. It is further stated that they are also eligible for assignment of lands in terms of the revised assignment policy enunciated by the Government vide G.O.Ms.No.1406 dated 26.07.1958. It is further stated that the petitioners are in possession of the land admeasuring Ac.3.00 gts., in Sy.Nos.1146/27 and 1146/1, situated at Ibrahimpatnam Khalsa, Ranga Reddy District and the said lands are assigned in favour of the pattadars under the Laoni Rules, 1950, prior to the revised assignment policy came into force i.e, 26.07.1958. It is further stated that as per the Laoni Rules, 1950, the original pattadars are entitled for alienation/transfer of land. It is further stated that the petitioners and their predecessors-in-interest have rendered services to original pattadars for more than four decades and in view of the longstanding services, the original pattadars/landlords are ready to relinquish their rights in favour of the petitioners. It is further stated that as per Rule 16 of the Andhra Pradesh (Telangana Area) Land Revenue Rules, 1951 (for short, ‘Rules, 1951’), the original pattadars are entitled for relinquishment/resignation/rajinama of their patta lands in favour of third parties or in favour of the Government. The grievance of the petitioners is that even though they are in possession of the subject land since long time and a representation has been made to the respondents, the respondents are not mutating their names in the revenue records.

4. Learned counsel for the petitioners submitted that due to non- mutation of the names of the petitioners, they are not eligible for any loans and other incentives sanctioned by the Government from time to time.

5. In view of the above, since the original pattadars are coming forward to execute relinquishment deeds in favour of the petitioners in accordance with the Rules, 1951, this Court is of the opinion that ends of justice would be met if the respondent No.5 is directed to consider the eligibility of the petitioners for assignment of lands as per the rules in force, after the relinquishment deeds being executed in favour of the petitioners by the pattdars and conduct enjoyment survey, by issuing notice to the original pattadars and other interested and affected parties and pass appropriate orders, in accordance with law.

6. With the aforesaid directions, this Writ Petition is disposed of.

As a sequel, miscellaneous applications pending if any, shall stand closed. No costs.
