ORDER

Heard learned counsel appearing for the petitioner and Sri Raparthi Venkatesh, learned Standing counsel appearing for respondent Nos.2 to 4. Perused the record.

2. Petitioner herein is a builder. It has constructed flats over land in Sy.Nos.84 to 87, situated at Hafeezpet village, Serilingampally mandal, within GHMC limits. It is called ‘Aditya Imperial Heights’ project. The purchasers of the flats formed into an association viz., Aditya Imperial Heights Project Welfare Association. They are making construction of hall + 2 rooms in the parking area, which is earmarked for the purpose of amenities. The same is un-authorized construction. Therefore, on the complaint lodged by the petitioner herein, respondent No.3 has passed a speaking order, dated 31.01.2024 directing the said association to remove the said un-authorized construction within 15 days. Even then, they have not removed the same. Respondent No.3 is not proceeding further. However, he has addressed a letter, dated 20.02.2024 to the Nodal Officer and Deputy Commissioner, Patancheruvu, Circle-22, GHMC to remove the said un-authorized construction pursuant to the aforesaid speaking order. Even then, the Nodal Officer did not act upon the same. Aggrieved by the said inaction of the Nodal Officer, petitioner filed the present writ petition.

Whereas, Sri Raparthi Venkatesh, learned Standing counsel appearing for respondent Nos.2 to 4, on instructions, would submit that respondent No.3 himself is the Nodal Officer and he will take action pursuant to the speaking order, dated 31.01.2024 and also letter dated 20.02.2024, strictly in accordance with the procedure laid down under the GHMC Act, 1955.

In the light of the said submission, this Writ Petition is disposed of directing respondent No.3 to take further steps pursuant to the speaking order, dated 31.01.2024 and letter dated 20.02.2024, strictly in accordance with the procedure laid down under the GHMC Act, 1955, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
