ORDER:
This writ Petition is filed under Article 226 of the Constitution of India, to call for the records, pertaining to F.I.R.No.43 of 2016 dated 20.01.2016 on the file of Chilkalguda Police Station, Hyderabad Golconda Police Station, Hyderabad registered for the offences punishable under Section 420, 406 of Indian Penal Code (for short “I.P.C”) and Section 7 of Essential Commodities Act, 1955 (for short ‘E.C.Act’).
2. Briefly the case of the prosecution is that on 19.01.2016 at 06.00 PM Lw.11 received credible information from the officials of Central Zone Team, Commissioner’s Task Force, Hyderabad about illegal transportation of PDS rice (08) bags and Wheat (05) bags through vehicle bearing No.TS 08 UA 4502. Thereafter, intercepted the vehicle at premises of Tipparthy village, Nalgonda District questioned the auto driver, but he did not show any bills pertaining to stock available in the vehicle. Thereafter, Lw.11 conducted panchanama and seized the available PDS commodities and vehicle under Section 6A of Essential Commodities Act and handed over the same to the incharge of MLS point circle IX Hyderabad for
