ORDER:

This writ Petition is filed under Article 226 of the Constitution of India, to call for the records, pertaining to F.I.R.No.487 of 2014 dated 24.08.2014 on the file of the Mailardevpally Police Station, Ranga Reddy District, registered for the offence punishable under Sections 420 of Indian Penal Code (for short “I.P.C”) and Section 7 of Essential Commodities Act, 1955 (for short ‘E.C.Act’).

2. Briefly the case of the prosecution is that on 23.08.2013 the complainant/Civil Supply & Vigilance Enforcement Officer has conducted inspection of rice godown situated at H.No.6-6-1, before Shivarampally Railway gate, Adarsh Nagar, Kattedan, Rajendranagar Mandal and seized the 178 bags of suspected PDS rice each 50kgs (89.00 qtls) including lorry bearing No.AP 16 TX 3407, the godown lease owner/accused Nos.3 and 4, who has claimed the rice and the accused No.1 was lorry owner and accused No.2 was cleaner of the lorry.
