ORDER:

This Criminal Petition is filed under Section 528 Bharatiya Nagarik Suraksha Sanhita (for short ‘BNSS’) by the petitioners/accused No.2 to quash the proceedings in Crl.M.P.No.5 of 2024 in Crime No.114 of 2024 on the file of learned Judicial Magistrate of Second Class at Alampur.

2. The brief facts of the case are that the petitioner filed the petition under Section 451 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) to return the Goods Carriage bearing No.AP 26 TT 8596, which was seized by the Undavelly Police in Crime No.114 of 2024, registered for the offences punishable under Sections 6 and 10 of the Telangana Prohibition of Cow Slaughter and Animal Preservation Act, 1977, Section 11 of the Prevention of Cruelty of the Animals Act, 1960. After hearing both sides, the trial Court dismissed the said petition. Aggrieved by the said order, the present Criminal Petition is filed.
