ORDER:
Heard Sri Y. Ashok Raj, learned counsel appearing on behalf of the petitioner, Sri Nandigam Krishna Rao, learned Standing Counsel appearing on behalf of respondent Nos. 1 to 3.
2. The petitioner approached the Court seeking prayer as under:
“…to issue a writ order or orders or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 1 to 3 in not paying the damages/compensation for the loss caused to his house bearing No.20-153 due to blasting in open cast Project-II by the respondents or paying any compensation to the petitioner is illegal, arbitrary and consequently direct the respondents to pay the damages/compensation for the loss caused to his house due to blasting by the respondents and pass...”
3. It is represented by Sri Y. Ashok Raj, learned counsel appearing on behalf of the petitioner that the writ petitioner had passed away and in spite of the efforts of the learned counsel on record to contact the legal representative’s of the deceased writ petitioner, the learned counsel on record could not contact them. The learned counsel represents that the writ petition may be closed with an observation that in the event the legal representatives of the deceased petitioner Sunkavalli Venkata Subbarao, S/o Raghavulu, aged 76 years, R/o. H.No. 20-155, Sriramnagar Village, Manthani (post) – 505 184, Karimnagar District would intend to pursue the present case, they would be at liberty to pursue the same.

Taking into consideration the said submission of the learned counsel appearing on behalf of the deceased-w rit petitioner, the w rit petition is closed w ith an observation that in the event the legal heirs of the deceased/ petitioner Sunkavalli Venkata Subbarao, S/ o Raghavulu, aged 76 years, R/ o. H.No. 20-155, Sriramnagar Village, Manthani (post) – 505 184, Karimnagar District w ould w ant to approach the Court in future to pursue the present case they w ould be at liberty to pursue the same, and avail the remedies as are available to them under law . How ever, there shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall also stand closed.
