THE HON’BLE SMT. JUSTICE LALITHA KANNEGANTI WRIT PETITION No.11644 of 2022

ORDER:

This Writ Petition is filed questioning the action of the 3^rd respondent in trying to interfere with the civil disputes and demanding the petitioner to handover agriculture land in Survey No.329/3, admeasuring 2178 sq. yards and in Survey No.329/4, admeasuring 847 sq. yards, total admeasuring 3025 sq. yards, situated at Batasingaram Village, Abdullapurmet Revenue Mandal, Ranga Reddy District, contrary to injunction orders passed in I.A.No.980 of 2020 in O.S.No.566 of 2020 dated 30.12.2020 on the file of the Junior Civil Judge, Hayathnagar, Ranga Reddy District, as illegal and arbitrary.

2. Sri Kongala Mohan Goud, learned counsel for the petitioners, submits that the petitioners have filed O.S.No.566 of 2020 and obtained interim injunction. In spite of the same, at the behest of the unofficial respondent, in a high handed manner the respondent police are interfering with the civil disputes.

A counter-affidavit has been filed on behalf of the Station House Officer, Abdullapurmet Police Station, and it is stated by Sri S.Rama Mohan Rao, learned Assistant Government Pleader for Home, that basing on the complaint given by the 4^th respondent, Crime No.59 of 2021 for the offences under Sections 448, 427, 504 and 506 read with 34 IPC was registered against petitioner No.1 herein, who is arrayed accused No.1 along with two others. Except for conducting investigation into the said crime, the respondent police are not interfering with the possession of the petitioners.

4. Sri A.P. Reddy, learned counsel for respondent No.4, seeks time to file counter-affidavit. He submits that respondent No.4 has filed a suit and obtained injunction and suppressing the same, the petitioners herein filed another suit and obtained injunction. When, the petitioners were trying to interfere with the possession of respondent No.4, he filed a complaint and the same is registered. He further submits that only to mount pressure on the police, the present writ petition is filed.

5. In this case, admittedly there are civil disputes between the parties. If a complaint is given to the police, except conducting investigation, they have no jurisdiction to interfere with the civil disputes. It is submitted by learned Assistant Government Pleader for Home that respondent police are not interfering with the civil disputes, except conducting investigation.

6. In view of the same, the Writ Petition is disposed of directing the respondent police not to interfere with the civil disputes, except for conducting investigation in the said crime, in accordance with law. No order as to costs.

Miscellaneous applications, pending if any, shall stand closed.
