This appeal is filed by the petitioners/appellants, challenging the award passed by the Chairman, Motor Accident Claims Tribunal – Cum – X Additional Chief Judge, City Civil Court, Hyderabad, in M.V.O.P.No.995 of 2012, dated
29.06.2015.
2. This appeal is filed by the dependants of the deceased, who died in the motor vehicle accident that occurred on 13.04.2008. The dependants have filed the claim petition seeking compensation of Rs.10,00,000/- and the Tribunal has granted an award of compensation of Rs.2,73,500/-. Seeking enhancement of the compensation, this appeal is filed.
3. The learned counsel for the appellants submits that the deceased was 30 years of age at time of accident and the same is also recorded in the inquest report as well as FIR and in post mortem report. He further submits that without any evidence and by only looking at the photographs of the deceased and his wife, the Tribunal had taken the age of the deceased as 55 years and accordingly applied the multiplier of 11. He submits that the age of the deceased should be correctly adopted at 30 years.
