IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
K.SURENDER, J
TAPPA PAKEERAPPA – Appellant
Versus
THE STATE OF TELANGANA REP BY P.P AND ANOTHER – Respondent
CRLP/10825/2017

COMMON ORDER:

Criminal Petition No.10825 of 2017 is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) by the petitioner/A10 to quash the proceedings against him in Spl.S.C.No.133 of 2017 on the file of Special Sessions Judge for SC/STs-cum-VII Additional District & Sessions Judge at Mahabubnagar. The offences alleged against the petitioner are under Sections 147, 148, 452, 427, 324, 323 r/w.149 of the Indian Penal Code and Section 3(1)(r)(s) of the SC/STs (POA) Amendment Act, 2015.

2. Criminal Petition No.12629 of 2017 is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) by the petitioner/A10 to quash the order dated 25.11.2017 passed in Crl.MP.No.968 of 2017 in Spl.SC.No.133/2017 on the file of VII Additional District Judge, whereby the learned Sessions Judge refused to cancel the NBWs and dismissed the application.

3. Since the petitioner and case number in both the criminal petitions is one and the same, both the criminal petitions are heard together and disposed off by this common order.

4. No interim orders were passed by this Court when the case was filed in the year 2017. The stage of the case before the trial Court is not known. In view of the same, I do not find any reason to keep the petitions pending.

5. Accordingly, both the Criminal petitions are disposed off granting liberty to the petitioner to approach this Court, if cause survives.

Miscellaneous applications pending, if any, shall stand closed.
