This writ petition is filed by the petitioner seeking to declare the action of respondent Nos.3 and 5 in not considering the Dharani application bearing No.2300139147 dated 07.09.2023 submitted by the petitioner for changing the nature of land from ‘Assigned’ to ‘patta’ in respect of land admeasuring Acs.3-00 guntas in Sy.No.599/31 situated at Fasalwadi Village, Sanga reddy Mandal and District, and to remove the subject land from the Prohibitory Properties list, as illegal and arbitrary.

2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Revenue appearing for respondents, and perused the material on record.

Learned counsel for the petitioner has submitted that the petitioner is the absolute owner and possessor of the land admeasuring Acs.3-00 guntas in Sy.No.599/31 situated at Fasalwadi Village, Sangareddy Mandal and District, having acquired the same from her husband Mr. R. Narender Reddy. The husband of the petitioner acquired the subject land by paying upset price/premium of sixteen (16) times as per Rule 9(g) of the Laoni Rules and he was also issued Laoni Patta Certificate. The name of husband of the petitioner was mutated in the revenue records and his name is reflected in the Faisal Patti for the year 1977-78. The subject lands were not hit by provisions of the Telangana Assigned Lands (Prohibition of Transfers) Act, 1977.

Learned counsel for the petitioner has further submitted that the revenue authorities while updating the land of the petitioner in Dharani portal has erroneously updated the subject land of the petitioner as ‘Assigned’ land and further included the above land in the Prohibitory Properties list. The petitioner has submitted Dharani application bearing No.2300139147 dated 07.09.2023 for changing the nature of land from ‘Assigned’ to ‘Patta’ and for deletion of the subject land from the Prohibitory properties list. However, there is inaction on the part of respondents’ authorities in processing the Dharani application of the petitioner. Therefore, she is constrained to approach this Court and filed the present writ petition.

5. Learned Assistant Government Pleader for Revenue appearing for respondents has submitted that appropriate action will be taken on the Dharani application of the petitioner, in accordance with law.

Recording the aforesaid submissions of the learned Assistant Government Pleader for Revenue, without going into the merits of the case, the writ petition is disposed of directing respondent Nos.3 and 5 to consider the Dharani application bearing No.2300139147 dated 07.09.2023 submitted by the petitioner for changing the nature of land from ‘Assigned’ to ‘Patta’ and to remove the same from the prohibitiory properties list, in respect of the land admeasuring Acs.3-00 guntas in Sy.No.599/31 situated at Fasalwadi Village, Sanga reddy Mandal and District, by issuing notice to all concerned/interested persons, and pass orders, in accordance with law, within a period of forty five (45) days from the date of receipt of a copy of this order. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
