This writ petition is filed by the petitioners seeking to declare the action of respondent Nos.2 and 3 in not considering the representation of the petitioners dated 20.10.2023 for rectification of revenue entries in Dharani portal, by deleting the entry of ‘Laoni’ Patta and correcting it to ‘Patta’ Land, in respect of the lands of the petitioners in Survey No.113/5 situated at Yadgarpalli Village, Keesara Mandal, Medchal-Malkajgiri District, as being illegal and arbitrary.

2. Heard learned counsel for the petitioners, learned Assistant Government Pleader for Revenue for respondents, and perused the material on record.

Learned counsel for the petitioners has submitted that petitioner No.1 is the owner of the land admeasuring 1-00 guntas in Survey No.113/5/39/AA, petitioner No.2 is the owner of the land admeasuring Ac.1-00 guntas in Survey No.113/5/39/A, petitioner No.3 is the owner of land admeasuring Ac.0-0675 guntas in Survey No.113/5/38/A/3, petitioner No.4 is the owner of land admeasuring Ac.0-0675 guntas in Survey No.113/5/38/A/3, petitioner No.5 is the owner of the land admeasuring Ac.0-0675 guntas in Survey No.113/5/38/A/2, petitioner No.6 is the owner of the land admeasuring Ac.0-0675 guntas in Survey No.113/5/38/A/1, petitioner No.7 is the owner of the land admeasuring Acs.2-27 guntas in Survey No.113/5/13/1, petitioner No.8 is the owner of the land admeasuring Acs.2-27 guntas in Survey No.113/5/13/2, petitioner No.9 is the owner of the land admeasuring Acs.3-00 guntas in Survey No.113/5/47, petitioner No.10 is the owner of the land admeasuring Acs.5-00 guntas in Survey No.113/5/12, petitioner No.11 is the owner of the land admeasuring Acs.0-20 guntas in Survey No.113/5/7B/1, petitioner No.12 is the owner of the land admeasuring Acs.2-00 guntas in Survey No.113/5/7A, petitioner No.13 is the owner of the land admeasuring Acs.2-26 ½ guntas in Survey No.113/5/13/3, petitioner No.14 is the owner of the land admeasuring Acs.2-00 guntas in Survey No.113/5/23, petitioner No.15 is the owner of the land admeasuring Acs.2-00 guntas in Survey No.113/5/7, petitioner No.16 is the owner of the land admeasuring Acs.3-00 guntas in Survey No.113/5/48 and petitioner No.17 is the owner of the land admeasuring Acs.0-26 guntas in Survey No.113/5/38/E situated at Yadgarpalli Village, Keesara Mandal, Medchal Malkajgiri District.

It is submitted that the lands in Survey No.113/5 were recorded as ‘Patta’ land till 1973-74 and in the year 1973-74, they were re-classified as ‘Laoni’ Patta, thereafter, they were notified under Section 22-A of the Registration Act. Except the land in Survey No.113/5, the other lands in Survey No.113/1, 113/2, 113/3 and 113/4 were recorded as patta lands. Despite paying sixteen (16) times land revenue by the ancestors of the petitioners, the same recorded in File No.A7/3430/1958 dated 28.10.1959, in the revenue records the land is classified as ‘Laoni’ Patta. Petitioners have submitted a representation to respondents on 20.10.2023 seeking re-classification of the subject land as in Proc.No.D1/24/Passbook Data Correction/Keesara/2023-57 dated .09.2023, but there is inaction on the part of respondents in processing the representation. Hence, they are constrained to approach this Court.

Learned Assistant Government Pleader for Revenue appearing for respondents has submitted that Government has introduced Dharani Land Management System and digitized entire revenue system, whereby every application for mutation, correction of wrong entries, issuance of e-pattadar passbook or deletion of lands from the Prohibitory Properties List etc. have to be made online through appropriate module in Dharani portal and the same would be processed, in accordance with law.
