JUDGMENT:

Aggrieved by the quantum of compensation awarded, the petitioners/claimants (hereinafter ‘the petitioners’) filed this Appeal against the decree and award dated 20.09.2006 in OP.No.416 of 2004 passed by the Chairman, Motor Accidents Claims Tribunal – cum–I-Additional District Judge, Mahabubnagar.

2. The petition was filed under Section 166 of Motor Vehicles Act, 1988, claiming compensation of Rs.10 lakhs for the death of Sri Naga Raju Nehru/deceased in a motor accident, by his wife and two minor children. The mother of the deceased was arrayed as the 2^nd respondent.

The case of the petitioners in brief is that on 25.04.2004 at about 2.30 pm., while Naga Raju Nehru / deceased was proceeding on his motor cycle bearing registration No.AP22F 7921 and reached near Ramireddypally bus stop, the bus bearing registration No.AP10Z 2645 of APSRTC, driven by its driver in a rash and negligent manner, came in opposite direction and struck the motor cycle and caused his instantaneous death. Thus, the petitioners pleading loss of dependency filed the petition seeking compensation.
