JUDGMENT:

Aggrieved by the quantum of compensation awarded, the petitioners/claimants (hereinafter ‘the petitioners’) filed this Appeal against the decree and award dated 20.09.2006 in OP.No.416 of 2004 passed by the Chairman, Motor Accidents Claims Tribunal – cum–I-Additional District Judge, Mahabubnagar.

2. The petition was filed under Section 166 of Motor Vehicles Act, 1988, claiming compensation of Rs.10 lakhs for the death of Sri Naga Raju Nehru/deceased in a motor accident, by his wife and two minor children. The mother of the deceased was arrayed as the 2nd respondent.

3. The case of the petitioners in brief is that on 25.04.2004 at about 2.30 pm., while Naga Raju Nehru / deceased was proceeding on his motor cycle bearing registration No.AP22F 7921 and reached near Ramireddypally bus stop, the bus bearing registration No.AP10Z 2645 of APSRTC, driven by its driver in a rash and negligent manner, came in opposite direction and struck the motor cycle and caused his instantaneous death. Thus, the petitioners pleading loss of dependency filed the petition seeking compensation.
