ORDER

The present Criminal Petition is filed under Section – 482 of the Code of Criminal Procedure, 1973, to quash the proceedings against the petitioners in C.C. No.1639 of 2020 on the file of IV Judicial Magistrate of First Class, Warangal.

2. The petitioners herein are accused Nos.1 to 3 in C.C.No.1639 of 2020. The offences alleged against them are under Sections - 420 and 506 read with 34 of IPC.

3. Heard Mr. M. Arvind, learned counsel for the petitioners and Mr. K. Rajashekar, learned counsel for respondent No.2 and also learned Assistant Public Prosecutor appearing on behalf of respondent No.2 - State.

4. PROSECUTION CASE

As per the charge sheet, allegations against the petitioners herein are as follows:

(i) on 21.01.2019, petitioner No.1 entered into an agreement orally with respondent No.2 and his brother-in-law (LWs.1 and 2) in respect of sale of agricultural land in various survey numbers making a total extent of Acs.60.00 guntas, situated at Gannavaram village of Rayaparthi Mandal, Warangal District @ Rs.13,00,000/-per acre;

(ii) pursuant to the said agreement, LWs.1 and 2 paid an amount of Rs.10,00,000/- (Rupees ten lakhs only) each to petitioner No.1 by way of cheques towards
