COMMON ORDER:
1. Crl.P.No.10220 of 2022 is filed by husband and Crl.P.No.10814 of 2022 is filed by wife. Since the impugned order challenged by the parties in both the criminal petitions, is one and the same, both the Criminal Petitions are heard together and common order is passed.
2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent (cid:150) State. Perused the record.
3. Both the criminal petitions are filed by the wife along with minor son and husband aggrieved by a common order passed in Crl.MP.Nos.533 & 536 of 2022 in M.C.No.259 of 2018. The wife/1st petitioner in Crl.P.No.10814 of 2022 has filed maintenance case vide M.C.No.259 of 2018 against husband who is petitioner in Crl.P.No.10220 of 2022, for maintenance. The Court below in the said MC passed an order dated 11.03.2019, granting maintenance of Rs.40,000/- to the wife and Rs.20,000/- to the minor son.
4. Aggrieved by the said exparte order granting maintenance, the husband filed the Crl.MP.No.533 of 2022 for appointing his mother as GPA to prosecute his case, and Crl.MP.No.536 of 2022 to set aside the exparte order dt.11.03.2019.
