HIGH COURT FOR STATE OF TELANGANA
PULLA KARTHIK, ABHINAND KUMAR SHAVILI, JJ
Government
WP/40270/2015

Courts/Tribunals cannot issue a mandamus or direction for regularisation of services of casual labourers.

Headnote:

CASUAL LABOURERS - ENGAGEMENT - THROUGH CONTRACTORS - VALIDITY - CENTRAL ADMINISTRATIVE TRIBUNAL - JURISDICTION - REGULARSATION OF SERVICES - MANDAMUS - NOT PERMISSIBLE

Fact of the Case:

The petitioners were casual labourers engaged by the Commissionerates on different dates between 1993 to 2003. The petitioners were aggrieved by the fact that they were being paid from the contingency funds and that most of them, engaged in cleaning, sweeping and gardening duties in the respondent-organisation, were sought to be disengaged by introduction of a new procedure of outsourcing and thereby engaging their services through contractors.

Finding of the Court:

The Central Administrative Tribunal held that the petitioners were never entitled to get the relief as prayed for. However, the Tribunal held that there was work and that they needed the role of the workers but for the ban and non-availability of funds, they had adopted a new method to get work done, by casual labour through a contractor. Therefore, the petitioners engaged earlier by the respondents and since the entire case of the respondents in the O.A. showed who were continuing for a long period, should not be dislodged by freshers even through the contractors, and on lifting of the ban on the engagement of casual labourers and on availability of funds, the respondents shall consider the case of the petitioners for the purpose of regularisation of their services, if necessary, by formulating a scheme for the said purpose.

Issues: 1. Whether the Central Administrative Tribunal has jurisdiction to issue a mandamus for regularisation of services of casual labourers? 2. Whether the engagement of casual labourers through contractors is valid?

Ratio Decidendi: 1. The Supreme Court in Umadevi held that Courts/Tribunals ought not to issue a mandamus or direction for regularisation of the services of casual labourers. 2. The mode and the manner of engagement of the services of casual labourers is for the Commissionerates, in their wisdom, to decide and not for Courts/Tribunals to impose.

Final Decision: The writ petitions were disposed of accordingly, leaving it open to the casual labourers concerned to avail such other remedies as are available to them in law, to agitate their grievances with regards engagement of their services through the contractors for works in Commissionerates, which according to them are permanent and perennial in nature.

COMMON ORDER:

When these matters are taken up for hearing, learned Standing Counsel for Central Government appearing for the petitioners submitted that the issue raised in the present Writ Petitions is squarely covered by the common order, dated 03.08.2006, passed by this Court in W.P.No.14715 of 2005 and batch and following the aforesaid common order, the present Writ Petitions are also liable to be disposed of.

2. In view of the said submissions, this Court is of the considered view that the present Writ Petitions also deserve to be disposed of following the aForesaid common order, dated 03.08.2006, passed by this Court in W.P.No.14715 of 2005 and batch.

3.

Accordingly, the Writ Petitions are disposed of following the aforesaid common order, dated 03.08.2006, passed by this Court in W.P.No.14715 of 2005 and batch. There shall be no order as to costs.
