O R D E R:
This Criminal Revision Case is filed by the revision petitioner-accused aggrieved by the judgment dated 26.02.2010 in Criminal Appeal No.318 of 2009 on the file of learned VII Additional Metropolitan Sessions Judge (cid:150) cum (cid:150) XXI Additional Chief Judge, Hyderabad, wherein the appellate Court while confirming the conviction and retaining the fine amount imposed by the learned XV Additional Judge (cid:150) cum (cid:150) XIX Additional Chief Metropolitan Magistrate, Hyderabad in C.C.No.26 of 2009, has reduced the sentence from one year to six months.
2. The facts in brief, as can be seen from the record are as under:
a) The respondent No. 1 - complainant being a company incorporated under Indian Companies Act was carrying business in pharmaceuticals and supply material to the customers in normal course of business. The revision petitioner - accused has placed orders to the complainant company for supply of Omerprazole pellets. As per the order dated 21.12.2006 the complainant has supplied the said product under invoice No.509 dated 29.01.2007 and invoice No.510 dated 30.01.2007 total worth of Rs.9,52,912/-.
