ORDER:

This is a petition filed under Section 439 Cr.P.C.

seeking the Court to enlarge the petitioner who is an accused in S.C.No.103 of 2019, on the file of the Court of VII Additional Metropolitan Sessions Judge-cum-XXI Additional Chief Judge, Hyderabad, on bail. The said case was being dealt with for the offence punishable under Section 307 I.P.C. 2. Heard the submission of the learned counsel appearing for the petitioner/accused and the learned Assistant Public Prosecutor, who is appearing for the Respondent.

3. Learned counsel for the petitioner submits that the petitioner is an accused in S.C.No.103 of 2019, which is pending before the Court of VII Additional Metropolitan Sessions Judge, Hyderabad. Learned counsel for the petitioner also states that the petitioner was enlarged on bail by the Sessions Court and unknowingly the petitioner after obtaining bail, left India and thereafter, on numbering the Sessions Case, summons were issued and as the summons could not be served upon the petitioner/accused, Non- bailable warrant was issued against him.
