When the matter is taken up for hearing, learned counsel for the petitioner had contended that the respondents have approached the Central Administrative Tribunal seeking a direction to extend benelit of judgment of a Full Bench of Central Administrative Tribunal, Mumbai rendered in Sh. Babu Rao Shankar Dhuri and others os. Union oJ India and re fix their gratuity taking into account 97%o of DA which they were paid prior to their superannuation and to pay the difference amount of gratuity which was not paid at the time of retirement ald the Tribunal has allowed the O.A. by following the Full Bench judgment of Central Administrative Tribunal, Mumbai.
