ORDER

Petitioner is seeking to quash the proceedings against him in C.C.No.393 of 2018 on the file of XII Additional Chief Metropolitan Magistrate, Nampally at Hyderabad.

2. Heard learned counsel for petitioner and learned Assistant Public Prosecutor appearing for respondent No.2 and perused the record.

Respondent No.1, Party-in-person, has not appeared.

3. The aforesaid case has been registered against the petitioner for the offences under Sections 420, 379, 403 and 415 of IPC, Section 197(2) of Motor Vehicles Act and under Sections 472 and 156(3) of Cr.P.C. basing on the complaint, dated 03.05.2018. The allegation against the petitioner is that the de facto complainant has purchased a four wheeler truck bearing No.AP-10V-4090, which was hypothecated to HDFC Bank. On 15.02.2007, at about 04.00 p.m., the agents of the petitioner’s firm i.e. Magma Financial Corporation have obstructed the vehicle, seized the same illegally and shifted it to their godown. The complaint is that though the de facto complainant is not in due of any amount, the employees of JS, J Crl.P.No.3663 of 2019 petitioner’s company alleging that he was in due of five months instalment amounts, have seized the vehicle
