“… .to issue a writ order or direction more particularly one in the nature of a writ of Mandamus declaring the action of the respondents in not permitting the petitioner which is a ST Agency for transportation of fly ash and bottom ash from V, VI and VII Stages of KTPS as per the orders passed in W P No 11261/ 2023 Dt 04/ 04/ 2024 and also as per the proceedings of the 4th respondent in Proc No CE/ C/ T/ SE/ C/ TCDI/ EE/ C/ E and F/ KTPS FA/ D No 35/ 2024 Dt 06/ 08/ 2024 as highly illegal and arbitrary and consequently direct the respondents to issue appropriate orders and permit the petitioner to

transport the fly ash and bottom ash from V VI and VII Stages of KTPS which was reserved for the local ST Agencies and pass… .”

3 . The case of t h e pet it ion er as per t h e av er m en t s m ade by t h e pet it ion er in t h e affidavit filed by t h e pet it ion er in su ppor t of t h e pr esen t W r it Pet it ion is as u n der :-

a) It is the case of the petitioner that the respondents issued a tender notice under Proc No.CE/ C/ T/ SE/ C/ TCD- 1/ E&7/ DVN/ KTPS Pond ash/ D.No.78/ 23, dated 11-04-2023, inviting tenders for the sale of pond ash from KTPS stages V, VI, and VII, and the sale of wet bottom ash from KTPS stage VI, Paloncha, for the years 2023 and 2024. This Hon’ble Court, in WP No. 11261 of 2023 on 04-04-2024, set aside the aforementioned tender notice.

b) Further on 09-09-2024, the 9 th respondent issued a publication stating that KTPS stages V, VI, and VII were inviting applications from ST individuals, specifying that only applicants from Karakavaagu, Punukula, Pullaiahgudem, and Suraram were eligible.

The petitioner submitted

representations dated 18-09-2024 and 19-10-2024 requesting that other villages, like Gajulagudem and Pandurangapuram, also to be considered. The petitioner belongs to the ST community, and their village is within the agency area of KTPS stages V, VI, and VII. However, the respondents did not consider the representations made by the petitioner and appear to be granting permission to certain third parties.

Aggrieved by this, the present writ petition has been filed.
