ORDER:
This petition is filed by the petitioners-accused Nos.1 to 5 under Section 438 Cr.P.C. seeking to grant anticipatory bail in the event of their arrest in Crime No.60 of 2024 on the file of KPHB Colony Police Station, Cyberabad District, for the offences under Sections 120-B, 409, 406, 420, 464, 466, 467, 470, 471, 474, 506 read with 34 IPC and Section 156 (3)
Cr.P.C.
2. The case of the prosecution in brief was that on a private complaint filed by the respondent No.2, which was referred to the police, the above crime was registered. The respondent No.2-complainant alleged in the complaint that he thought of purchasing a land. The petitioner Nos.1 and 2, who were wife and husband, and the petitioner No.4, who was their relative, approached him and introduced themselves as realtors and owners of M/s. Y & Y Infra Constructions located at Visakhapatnam. They had shown two vacant lands which were either too expensive or having legal issues. Thereafter, they had convinced him to deposit/invest an amount of Rs.30.00 lakhs in their business on profit sharing basis. Believing their words, he invested Rs.30.00 lakhs in cash on 07.11.2020 and entered into an investment agreement duly signed by the petitioner No.1. After few months, the petitioner Nos.1, 2 and 4 again approached him and convinced him to invest another Rs.40.00 lakhs with them so that he could get good returns. Since he was getting profit sharing installments, he got convinced and invested another amount of Rs.40.00 lakhs with them on various dates. They paid an amount of Rs.12,63,000/- in multiple installments as profit from their business. Later, they stopped paying any amount due to which the principal amount and interest was piled upto Rs.85.00 lakhs. On repeated demands, the petitioner Nos.1, 2 and 4 came up with another fraudulent plan under the pretext of financial crisis and tried to convince him that they had an agreement of sale on one Nunna Ranjitha Chowdary for an open land situated at Samalkot Village, Kakinada District and if he could invest another Rs.50.00 lakhs for purchase of the said land, they could include him as a co-purchaser having 50% share in the said property and also proposed to register an Agricultural land belonging to the petitioner No.1 situated at Guthenadeevi village, I.Polavaram Mandal, Dr. B.R. Ambedkar Konaseema District, A.P. worth Rs.50.00 lakhs towards part repayment out of the total outstanding of Rs.85.00 lakhs. To recover his money, he agreed for the said proposal for investing another Rs.50.00 lakhs additionally and entered into a memorandum of understanding on
16.03.2023 by including all terms and conditions. On 27.03.2023 as part of his additional investment, the complainant gave Rs.30.00 lakhs to the petitioner Nos.1, 2 and 4. He gave cash of Rs.25,86,100/- and remaining Rs.4,13,900/- transferred online along with the bank charges. On the same day, the petitioner No.1, executed a sale deed for the agricultural land situated at Guthenadeevi village on his name duly registered as document No.3099 of 2023 at the Sub-Registrar Office, Amalapuram. At the time of receiving Rs.30.00 lakhs, the petitioner No.1 asked him to transfer another Rs.9.00 lakhs within two days to Nunna Ranjitha Chowdary’s bank account, who was the original owner of the open land situated at Samalkot and gave an account number purported to be belonging to her. On 29.03.2023, he transferred Rs.9.00 lakhs to the above Nunna Ranjitha Chowdary’s bank account and also transferred the remaining Rs.11.00 lakhs to the petitioner No.1’s bank account within three days from various accounts. After receiving the entire amount of Rs.50.00 lakhs additionally, all the petitioners stopped responding to him and even if they responded they started giving evasive replies. They conveyed that due to urgency of Nunna Rajitha Chowdary they got the entire land registered in favour of petitioner No.1 vide document No.3099 of 2023 dated 17.04.2023 duly registered at Samalkot,, with
