COMMON JUDGMENT:
1. These two appeals are being disposed of by this common judgment since M.A.C.M.A.No.1566 of 2016, filed by the claimants seeking for enhancement of compensation and M.A.C.M.A.No.2328 of 2016, filed by the Insurance Company challenging the compensation awarded, both are directed against the very same Award and Decree, dated 04.07.2015 passed in O.P.No.1508 of 2013, on the file of the Motor Accidents Claims Tribunal-cum- II Additional Chief Judge, City Civil Court, Hyderabad (for short, “the Tribunal”).
2. For the sake of convenience, the parties hereinafter be referred as they were arrayed before the Tribunal.
3. The facts of the case, in brief, are that the claim petitioners, who are the wife and children of Late V.Shankar Rao (hereinafter be referred as “the deceased”), filed a petition under Section 166 of the Motor Vehicles Act, 1988, claiming compensation of Rs.15,00,000/- on account of the death of the deceased in a motor vehicle accident caused with the Car bearing No.AP-10M-9068 on 03.02.2013.
