ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“…to issue an appropriate Writ, Order, or Direction, particularly in the nature of WRIT OF MANDAMUS declaring the action of the 2nd respondent not sending the petitioners for the training for the post of SCT PC (AR) in Hyderabad Police Cimmissionerate Unit, SCT PC (TSSP) in CDC-I (Nirmal District Unit) and SCT PC (AR) in Medak District Unit respectively which commenced from 01.04.2024 pursuant to Notification vide No. Re No. 41/Rect./Admn.1/2022 Date: 25.04.2022 Despite his clean and acquittal from the case of C.C. No.416/2023 dated 06.07.2023 U/Ss 147, 448, R/w. 149 of IPC and Sec. 239 of PDPP Act IV Addl. Chief Metropolitan Magistrate Court, At Nampally, Hyderabad as is unjust, illegal, arbitrary, and violative of Articles 14 and 21 of the Constitution of India and consequently, direct the 2nd Respondent to send the petitioner immediately to ongoing training which commenced from 01.04.2024 and to pass…”

2. Heard Sri Ramesh Chilla, learned counsel appearing for the petitioners and Sri M.V. Rama Rao, learned Standing Counsel for respondent No.2-Telangana State-level Police Recruitment Board. With their consent, the writ petition is taken up for disposal at admission stage.

Learned counsel appearing for the petitioners submits that the petitioners had applied for the post of Stipendiary Cadet Trainee - Police Constable as per the notification vide Rc.No.41/Rect./Admn.1/2022 dated 25.04.2022, participated in due process of selection, and successfully cleared all phases of tests such as Preliminary Written Test, Physical Measurement Test, Physical Efficiency Test and Final Written Examination. In pursuance of the same, the petitioners herein were selected for the posts of SCT PC (AR) in Hyderabad Police Commissionerate Unit, SCT PC (TSSP) in CDC-I (Nirmal District Unit), and SCT PC (AR) in Medak District Unit, respectively. He further submits that a criminal case was filed against the petitioners for the offences punishable under Sections 147, 448 r/w. 149 of the Indian Penal Code, 1860, and Section 3 of the Prevention of Damage to Public Property Act, 1984. Subsequently, a charge sheet was filed and the said criminal case was numbered as C.C.No.416 of 2023 on the file of the IV Additional Chief Metropolitan Magistrate, at Nampally, Hyderabad, and after conducting a full-fledged trial, the Court below acquitted the petitioners herein (arrayed as Accused Nos.7, 8 and 9 respectively) vide judgment dated 06.07.2023. While so, respondent No.2 called some of the selected candidates for Basic Induction Training. However, the petitioners were not called for attending the training. On enquiry, they were informed that the names of the candidates who were involved in criminal cases were not included in the Induction Training List. Learned counsel further submits that in spite of a clean and honorary acquittal from the said criminal case, respondent No.2 has not considered the petitioners’ candidature to send for the Induction Training. Therefore, the petitioners submitted their individual representations on 06.03.2024 and a common representation on 11.03.2024, to respondent No.2, requesting to send them for the Induction Training. However, no action has been taken thereon so far.

Therefore, learned counsel for the petitioners prays this Court to direct respondent No.2 to consider the representations of the petitioners dated 06.03.2024 and 11.03.2024, and pass appropriate orders within a reasonable period of time.

4. Learned Standing Counsel for respondent No.2 fairly submits that respondent No.2 will consider the representations of the petitioners dated 06.03.2024 and 11.03.2024, and pass necessary orders in accordance with law.

5. Having regard to the submissions made by the learned counsel appearing for the respective parties, without going into merits of the case, the Writ Petition is disposed of with a direction to respondent
