ORDER:
This writ petition is filed seeking to declare the action of the respondent in publishing the notification dated 21.01.2006 in the A.P. Gazette No.19, Part-II Extra Ordinary under Section 10(1) of the Urban Land (Ceiling & Regulation) Act, 1976 (for short, ‘Act, 1976’), another Notification dated 07.02.2006 published in A.P. Gazette No.36, part II extraordinary under Section 10(3) of the Act, 1976 and issuing a notice under Section 10(5) of the Act, 1976 as illegal and arbitrary and consequently prayed this Court to set aside the same and for other appropriate reliefs.
2. Considered the submissions of the learned counsel for the respective parties and perused the record.
3. It is stated that the petitioner No.1 is a charitable trust undertaking the charitable activities. It is also stated that the petitioner No.1 is the absolute owner and possessor of property bearing H.No.1-65/70 with its appurtenant site, total admeasuring 469.83 sq.mts in Plot No.70, out of Sy.No.41 part of Guttalabegumpet Village, popularly known as Kavuri Hills, Hyderabad, having acquired the same under a gift deed bearing document No.7051 of 2004, dated 28.06.2004.
