THE HON’BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION No.15330 of 2023

ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“... to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus directing the Respondent No.4 to cancel the digital patta pass book bearing No.T01190030305, Khata No.409 issued in favour of Respondent No 5 in respect of the lands in Sy.No.139/e to an extent of Ac.01-14 Gts and

Sy.No.139/E to an extent of Ac.01-14 Gts situated at Pasupula Village, Marikal Mandal, Narayanapet District by oversight and pass …”

2. Considered the submissions of the learned counsel for the respective parties and perused the record.

3. The case of the petitioners is that petitioner No.1 is the absolute owner, possessor and pattadar of agricultural land admeasuring Ac.01-14 guntas in Sy.No.139/e; husband of petitioner No.2 namely Sri Shekar Reddy, who is the father of petitioner Nos.3 and 4 is the absolute owner, possessor and pattadars of Ac.01-14 guntas in Sy.No.139/E situated at Pasupula Village, Marikal Mandal, Narayanapet District. It is the further case of the petitioners that the husband of petitioner

No.2 died on 31.01.2023 leaving behind petitioner No.2 to 4 as legal heirs and their names were recorded in revenue records and pattadar passbooks were also issued in their favour vide Patta Pass Book Nos.317608 and 402834. It is the further case of the petitioners that when the State Government has digitalized the revenue records, the revenue authorities have e- pattadar passbooks in respect of subject land in favour of respondent No.5 and therefore, they made a representation before respondent No.4 for cancellation of said e-pattadar pass books issued in favuor of respondent No.5 and to restore the earlier entries in the revenue records and to issue e-pattadar pass books in respect of subject land in their favour, but respondent No.4 has not acted upon the said representation. It is the further case of the petitioners that respondent No.5 herself addressed a letter to respondent No.4 on 05.12.2020 bringing to the notice of revenue authorities that they have issued digital pass books in her favour in respect of the said land by mistakenly and she has no objection for transferring the same in favour of the original owners. The grievance of the petitioners is that even after depicting the nature of the lands as patta lands in their names, the respondents without conducting any enquiry have issued e-pattadar passbooks in favour of respondent No.5 and therefore, they have submitted online applications on 05.09.2022 and 21.10.2022 for cancellation of digital pass book issued in favour of respondent No.5; for pass book data correction and also not to pay the Rythu Bandhu to respondent No.5 in respect of the subject land, but the respondent authorities have simply rejected the said applications stating that there is no provision in Dharani Portal for rectification, cancellation of e-patta pass book.

4. This Court without expressing any opinion on the entitlement of the petitioners, since it is stated that the petitioners have submitted online applications seeking for correction of entries in the revenue records, ends of justice would be met if the respondents are directed to conduct a detailed enquiry with regard to the subject land and after issuing notices to all the effected parties, the respondents shall carry out necessary corrections in the revenue records, strictly in accordance with law, within a period of three months from the date of receipt of copy of this order.

5. With the above observations, this writ petition is disposed of. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
