ORDER:

This criminal revision petition is filed by the Petitioner/complainant under Sections 397 & 401 of Cr.P.C against the judgment dated 10-3-2014 of the I Additional Judicial Magistrate of First Class, Nizamabad in CC No.565 of 2011 as confirmed by the I Additional Sessions Judge, Nizamabad in Crl.A No.41 of 2014 dated 22-12-2014 for the offence under Section 138 of the Negotiable Instruments Act, (for short ‘NI Act).

2. The case of the petitioner/complainant in brief was that the complainant and accused were acquainted with each other as they belonged to the same locality. Out of the said acquaintance, the accused approached the complainant and requested for a hand loan of Rs.5.00 lakhs. Accordingly the complainant arranged cash of Rs.5.00 lakhs and gave it to the accused in the month of March 2007. The accused promised to repay the same on demand of the complainant. Thereafter, several times the complainant demanded the accused for repayment of the said amount, but the accused dragged the same on one pretext or the other and thereafter, the accused issued a cheque bearing No.617990 dated 7-5-2009 for a sum of Rs.5.00 lakhs in favour of the complainant towards discharge of the l
