RespondenUComplainant Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the Criminal Petition, the High Court may be pleased to enlarge the petitioners herein on bail in the event of their arrest ln connection with FIR No. 119 of 2020 on the file of the Women Police Station, Begumpet, Hyderabad.

The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of M/s GORLA JALAJA, Advocate for the Petitioner, Asst. PUBLIC PROSECUTOR for the Respondent, the Court made the following.

ORDER:

TI-IE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.931 of 2021 ORDER:

This Crimirral Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/Al seeking to grant anticipatory bail in the event ,rf his arrest in Cr.No.119 of 2020 on the file of Women Police Station, Begumpet, Hyderabad, registered for the offences punishable under Sections 498-A IPC and under Sections 3 and 6 of Dowry Prohibition Act.

2. Heard learned counsel for the petitioner/Al , learned Assistant Public Prosecutor appearing for the respondenlstate and perused the record.

3. Learned counsel for the petitioner/A1 would submit that the petitioner is innocent of the alleged offences as he has not committed any offence as alleged. He further submits that the de-facto complainant used to quarrel with thr: petitioner and.she never shown any interest to look after the welfare of the child and that she used to threaten him and his parents to implicatr: in dowry harassment case. He further submits that the police issued notice under Section 41-A Cr.P.C., and even before giving reply to the said notice, police are threatening to arrest the petitioner. He also submits that tre petitioner is a law abiding citizen and he is ready to abide by any cond tion that may be imposed by this Court in the event of his enlargement on anticipatory bail.

Learned Ass;istant Public Prosecutor vehemently opposed to grant anticipatory bail 1.o the petitioner f nd submits that notice under Section 41-A Cr.P.C., has already been issued to petitioner.

Having regard to the facts and circumstances and looking into the nature of allegations leveled against the petitioner and since nolice under Section 41-A Cr.P.C., has already been issued him, without adverting to the merits of the matter, I am inclined to grant anticipatory bail to the petitioner/41 .

The Criminal Petition is accordingly allowed and the petitioner/A1 is granted anlicipatory bail subject to the following terms and conditions:

(1) The petitioner/A1 is directed to surrender before the Station House Officer, Women Police Station, Begumpet, Hyderabad, within a period of 15 days from the date of this order and on such surrender, the said Station House Officer shall release lhe petitioner/Al on bail on his executing a personal bond to the tune of Rs.'15,000/- (Rupees fifteen thousand only) with two sureties for the like sum each to his satisfaction.

(2) On such release, the petitioner/Al shall appear before the lnvestigating Officer on 1"t and 3'd Saturday of every month between 10.00 AIV to 2.00 PN/ till completion of investigation or filing of the charge sheet whichever is earlier.

(3) The p '-,elitioner/Al shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

(4) The petitioner/A1 shall not misuse the liberty granted to him.
