ORDER:

This Civil Revision Petition is filed by the petitioner-

plaintiff aggrieved by the order passed in EA No.53 of 2024 in EP No.41 of 2023 on the file of Prl. District & Sessions Judge, Jogulamba Gadwal.

2. Heard Sri Peddada Sivadatta, learned counsel for the petitioner and Sri V.Y.Krishna Sainath representing Sri Mohd Rafiq learned counsel for the respondents.

3. Learned counsel for the petitioner submitted that petitioner/Debtor No.1 earlier filed EA No.53 of 2024 in EP No.41 of 2023 under Order 21 Rule 26 of CPC seeking stay of execution proceeding and to set aside the ex parte order in main suit, dated 06.09.2022, however, the said EA No.53 of 2024 in EP No.41 of 2023 was dismissed by the Prl. District and Sessions Judge, Jogulamba Gadwal on 17.04.2025, on the ground that there is no prima facie reason was made out for grant of stay of execution proceedings, as the Debtor No.1/petitioner herein has already paid an amount of Rs.5,50,000/- which clearly indicates and shows that Debtor No.1/petitioner herein was aware of the proceedings in MVOP No.17 of 2018 and EP No.41 of 2003.
