The Court made the following:

ORDER: (Per the Hon’ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of Habeas Corpus directing the respondents to produce the alleged detenus - Paruchuru Chitti Babu, S/o Thirupataiah; Sujatha, W/o P.Chitti Babu and Sai Lakshmi and Akhila – the daughters of P.Chitti Babu, before this Court and set them at liberty, after recording their statements.

2. A detailed counter-affidavit has been filed by respondent No.3, wherein he has denied the role of the Police in interfering with the life and liberty of the alleged detenus. He has further stated that as one of the alleged detenus – P.Chitti Babu contracted heavy debts and failed to repay the same, his creditors have been frequently visiting his house and that to avoid them, the said P.Chitti Babu has been staying indoors along with their family members without coming out, apprehending harm from his creditors.

Mr.C.Subodh, learned counsel for the petitioner, while saying that the Police are presently not interfering with the day-to-day life of the alleged detenus, however, stated that in order to seek redressal of his grievances against his creditors, who are illegally interfering with his life and liberty, the said P.Chitti Babu wants to meet the jurisdictional Magistrate and seek his intervention. The learned counsel has, therefore, requested that respondent No.3 may be directed to provide protection to the said P.Chitti Babu to enable him to meet the jurisdictional Magistrate and make a representation to him.

As we find the above request reasonable, respondent No.3 is directed to provide protection to P.Chitti Babu, S/o Thirupataiah, who is one of the alleged detenus, from 10.00 a.m. on 03.03.2018 to enable him to visit the Court/Chambers of the jurisdictional Magistrate for giving a representation to him. Respondent No.3 is further directed that the security so provided shall be continued till the said P.Chitti Babu completes his work with the Magistrate and returns home on the same day.

5. Subject to the above directions, the Writ Petition is disposed of.
