ORAL ORDER:
This Transfer Criminal Petition is filed with a prayer to transfer CC.No.917 of 2023 pending on the file of the III Additional Judicial Magistrate of First Class, Sessions Division, Warangal District, to the file of the Principal Junior Civil Judge cum IV Additional Metropolitan Magistrate, at LB.Nagar, Medchal Malkajgiri District, where DVC.No.12 of 2025 is pending.

Heard Sri Shaik Karimulla, learned counsel for petitioner, Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for respondent No.1 – State, and Sri Rapolu Bhaskar, learned counsel for respondent Nos.2 to 5. 3. Learned counsel for petitioner submitted that petitioner moved to LB.Nagar, subsequent to lodging of report before Warangal Police Station. He further submitted that no inconvenience would be caused to other side if the CC., is transferred as the accused No.1 is in UK. Therefore, prayed this Court to allow this transfer criminal petition.
4. On the other hand, the learned counsel appearing for respondents, opposed the submissions made by learned counsel for petitioner, contending that it was petitioner herself who lodged complaint before the Warangal Police Station and now filed petition to transfer the same. He further submitted that respondent Nos.3 and 4 are senior citizens and they would face difficulty in attending proceedings if the case is transferred. Therefore, he prayed this Court to dismiss the transfer criminal petition.

Upon consideration of the submissions advanced by both learned counsel and on careful examination of the record, it is noted that DVC.No.12 of 2025 is already pending on the file of the Principal Junior Civil Judge cum IV Additional Metropolitan Magistrate, at LB.Nagar, Medchal Malkajgiri District. For the convenience of parties, this Court deems it fit to allow this transfer criminal petition.
