This Criminal Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘ BNS S ’) by the petitioner/accused seeking to call for the records in Crime No.128 of 2025 on the file of Kalur Thimmandoddi Police Station, Jogulamba Gadwal, registered for the alleged offences punishable under Sections 318 (4), 316(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘ BNS ’).

2. Heard Sri R,S.Sumith Raj, learned counsel for the petitioner and Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State.

Learned counsel for the petitioner submitted that the petitioner has approached the High Court vide W.P.No.26821 of 2025, wherein the Coordinate Bench of this High Court has granted relief to the petitioner to continue with the Custom Milling Rice until the deficit quantity has been ascertained by the concerned authorities. However, complaint has been lodged on 09.09.2025 alleging that there is a shortfall in the quantity of CMR rice. Hence, he prayed to quash the proceedings against the petitioner.
