Court emphasized proper income assessment and future prospects in determining fair compensation in fatal accident claims.
Headnote:(A) Motor Vehicles Act - Compensation - Enhancement sought from Rs.17,95,240/- to Rs.35,00,000/- for death in motor accident - Court emphasized the need for compensation based on the deceased's actual income and future prospects, enhancing it to Rs.34,66,000/- with interest @7.5% from filing. (Paras 2, 13, 14)
(B) Relevant Judgment - Reference to Gurpreet Kaur case underlines the importance of adhering to welfare legislation objectives in compensation matters. (Para 10)
Facts of the case:
The deceased was a self-employed individual earning Rs.40,000/- monthly, but the Tribunal previously assessed his income at Rs.7,000/- leading to a lower compensation award.
Findings of Court:
Court found the deceased should be compensated based on a higher income assessment of Rs.15,000/- plus additional compensation for future prospects and other expenses.
Issues: The main issue was whether the Tribunal correctly assessed the monthly income of the deceased and subsequently the compensation amount.
Ratio Decidendi: The court ruled that the Tribunal’s assessment was inadequate and necessary adjustments be made for rightful compensation reflecting the deceased’s actual earning capacity.
Result: Appeal partially allowed to enhance compensation.
