ORDER
The present writ petition is filed questioning the action of respondent No.2 in taking steps to arrest the petitioner in FIR No.94 of 2025 dated 14.08.2025 on the file of respondent No.2 police station for the offence under sections 338, 336(2), 340(2), 318(4), 319(2) r/w 3(5) of BNS which are contrary to the directions of the guidelines issued by Hon’ble Supreme Court in Arnesh Kumar case.
2. The facts of the case in brief are that on 14.08.2025, a case was registered against the petitioner who is Tahsildar, Kondapaka Mandal by Maddur Police after preliminary enquiry basing on the complaint received on 01.08.2025 from the complainant i.e., respondent No.3, in which it is stated that 20 years ago, respondent No.3 migrated to Ameenpur, Hyderabad and eking livelihood by running a iron shop and that he has an agricultural land to an extent of 0.2500 guntas in Sy.No.196/A/3 and 0.2050 guntas in Sy.No.188/A5 which is his ancestral property.
