IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
K. SUJANA, J
Petitioner/Accused No. 4 – Appellant
Versus
State – Respondent
Criminal Petition No.9540 of 2025

Advocates:
For the Appellants/Petitioners: K. Sreenivas
For the Respondents: Syed Yasar Mamoon

The court established that serious allegations in cases of illegal abortions warrant denial of anticipatory bail due to the potential for evasion and the ongoing investigation.

Headnote:(A) Bharatiya Nagarik Suraksha Sanhita, 2023 - Section 482 - Medical Termination of Pregnancy Act - Sections 5(2), 5(3) - Pre-Conception & Pre-Natal Diagnostic Techniques Act, 1994 - Anticipatory bail sought by accused in connection with illegal abortion leading to death of a patient. (Paras 1-2)

(B) Anticipatory Bail - The petitioner, a medical practitioner, is implicated in an illegal abortion that resulted in a patient's death, with significant allegations against him. The court denied bail due to the severity of accusations and ongoing investigation. (Paras 4-6)

Facts of the case:
The petitioner is accused of participating in a criminal abortion at an unregistered facility which resulted in the death of a pregnant woman. The woman had prior consultations for similar complications and was reportedly coerced into seeking sex determination and illegal abortion. (Paras 1-2)

Findings of Court:
The court found the allegations against the petitioner credible, determining that given the serious nature of the accusations, granting anticipatory bail was inappropriate. The investigation was ongoing, and the petitioner's behavior was also questionable as attempts to abscond were noted. (Paras 6)

Issues: The central issue was whether the petitioner was implicated in the illegal abortion and if the evidence substantiated the charges against him. The court concluded there was enough ground to deny bail. (Paras 4-6)

Ratio Decidendi: The court ruled that the severity and nature of the allegations in cases of illegal abortions, particularly those resulting in death, necessitate stringent scrutiny. The ongoing investigation and potential for the accused to evade lawful processes further justified denial of bail. (Paras 6)

Result: Petition dismissed.
